  6. Partner Promotion. We may offer contests, sweepstakes, or other promotions with third party partners.  If you decide to enter a contest, sweepstakes, or promotion that is sponsored by a third party partner the information that you provide will be disclosed to us and with them.  Their use of your information is not governed by this Privacy Policy. When you use our website, we disclose information that we collect from you, such as your email (in hashed form), IP address or information about your browser or operating system, with our identity partners/service providers. Information in our first-party cookie for our use in online and cross-channel advertising may be disclosed with advertising companies to enable interest-based and targeted advertising.
  7. Service Providers. We may disclose your information with service providers.  Among other things service providers may help us to administer our website, conduct surveys, provide technical support, process payments, and assist in the fulfillment of orders.
  8. Social Media. Our website includes features such as, plugins, widgets, or and other tools made available by third parties that may result in information being collected or disclosed between us and the third party. The third party’s use of your information is not governed by this Privacy Policy. You may have the right to opt out of our use of these technologies, as further described in this Privacy Policy.

The Website currently uses the following third-party service providers:

  • Google Analytics – this service tracks website usage and provides information such as referring websites and user actions on our website. Google Analytics may capture your IP address, but no other personal information is captured by Google Analytics.
  • Payment Processing – this service is used to serve our ecommerce platform, GumRoad. At no time is your banking information passed to our website. We receive only information used for order fulfillment.
    Mail Chimp– this service is used for delivery of email updates and newsletters. We store your name and email address for purposes of delivering such communications.
  • Flodesk – this service is used for delivery of email updates and newsletters. We store your name and email address for purposes of delivering such communications.
  • We currently use OneSignal for delivery of push notifications. Please refer to the OneSignal privacy policy for more information.

Legal Basis for Processing Your Information

Where a legal basis for processing is required (e.g., in the European Union and the United Kingdom), we process your Personal Information for the Processing Purposes described in this Privacy Policy on the following legal grounds:

  • With Your Consent: In certain instances, we ask for your consent to process your Personal Information for specific purposes.  Provision of your consent is voluntary, and you have the right to withdraw your consent at any time.
  • When Pursuing Legitimate Interests: We process your Personal Information for our legitimate interests and those of third parties, while applying appropriate safeguards that protect your privacy, and as further described in this Privacy Policy.
  • To Perform a Contract With You: We will process your Personal Information when processing of your Personal Information is necessary for the evaluation, execution or performance of a contract with you.

  8. Right of Non-Discrimination/Retaliation. We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy, nor do we retaliate against individuals who exercise these rights.   
  9. Right to Opt Out of our Use of your Sensitive Personal Information (in certain instances and if permissible under applicable law).  We do not currently use or disclose Sensitive Personal Information for purposes other than those which cannot be limited under applicable law.

Please note that many of the above rights are subject to exceptions and limitations. Your rights and our responses will vary based on the circumstances of the request.  If you choose to assert any of these rights under applicable law, we will respond within the time period prescribed by such law.  In some cases, we may limit or deny your requests to access or delete your information.  This may occur because the law permits or requires us to do so, or if we are unable to adequately verify your identity.

Your information may be stored and processed in the United States or any other country in which Family Fresh Meals or its Service Providers maintain facilities.  In certain situations, we may transfer your Personal Information to countries where data protection laws are not considered to provide an equivalent level of privacy protection to that provided by the laws of your home country.
